In a recent report, the United States Trade Representative (USTR) placed Mexico on its 2025 Priority Watch List for intellectual property protection, citing prolonged concerns over enforcement gaps. According to Sergio Legorreta, partner at FisherBroyles, addressing these demands does not require new legislation but rather decisive application of existing mechanisms to secure goods and curb counterfeiting.
Legorreta emphasized that effective action could help ease long-standing trade frictions and send a positive signal ahead of the 2026 renegotiations of the USMCA. He pointed to Mexico’s 2009 success—when coordinated efforts with federal agencies led to the seizure of 40 million counterfeit goods annually—as proof that stronger enforcement is achievable. Today, however, seizures have dropped below one million items per year, underscoring the urgent need for customs-level solutions.
“Supporting intellectual property protections is not only about compliance,” Legorreta noted, “but about positioning Mexico as a reliable trade partner in the global economy.”
