Partner Anthony Davis and co-author Marcus Hartung discuss the various ethical challenges that generative Artificial Intelligence (“AI”) poses for lawyers who wish to take advantage of what many see as the promise of the tools that use this new technology. These challenges include, among others, the duty to protect client confidences, the risk of creating and passing on false information – “hallucination,” the need to reconcile technology use with appropriate billing practices, and the need to comply with court ordered protocols for submissions that include AI generated material. The article compares the ways in which U.S. and German professional regulation reach essentially similar guidance in addressing these challenges.
