FisherBroyles partner Sergio Legorreta has raised concerns over the rapid move by some social, indigenous, and Afro‑Mexican radio stations to sell advertising—reportedly for as little as 100 pesos per 30‑second slot—before the Telecommunications Regulatory Commission is formally operational.
Legorreta warns that this development takes place in a regulatory vacuum, with no clear safeguards or oversight in place. The coexistence of two telecom laws—the prior Peña Nieto framework and the newly enacted Sheinbaum law—further complicates compliance for market participants.
He emphasizes that integrating paid advertising into traditionally non‑commercial broadcasting marks a structural shift in Mexico’s media landscape. To ensure legal certainty, transparency, and fair competition, Legorreta urges the Telecommunications Regulatory Commission to issue clear, enforceable guidelines that protect both industry integrity and investor confidence.
For foreign investors, the absence of defined rules presents heightened operational and reputational risks, potentially deterring market entry or expansion plans.
