Biography

James Lin is a Partner in the Intellectual Property Litigation group at FisherBroyles, LLP. With more than 20 years of experience in patent, trademark, and trade secret litigation, James has represented technology companies in over 55 intellectual property disputes across U.S. federal venues, including seven investigations before the International Trade Commission (ITC) and eight inter partes reviews (IPRs) before the Patent Trial and Appeal Board (PTAB). His practice focuses on high-stakes technology disputes involving semiconductors, video and multimedia technologies, computer hardware, software systems, and advanced electronics.

James has extensive experience advising Asian technology companies navigating the U.S. intellectual property system. Over the course of his career, he has represented leading companies across Asia, including Hisense, Acer, Nanya Technology, Powerchip, ASE, Silicon Precision Industries, MiTAC, and the Industrial Technology Research Institute (ITRI). His work often involves coordinating cross-border litigation strategy, managing technical experts, and advising executives on U.S. patent litigation risk and licensing strategy.

Prior to joining FisherBroyles, James practiced at major international law firms including Orrick, Herrington & Sutcliffe, where he worked on complex patent disputes and ITC investigations involving global technology companies. His experience spans all phases of litigation, including pre-suit investigation, pleadings, discovery, claim construction, expert proceedings, dispositive motions, and trial preparation. James has second-chaired trials in both federal district courts and ITC investigations, working closely with lead trial counsel in high-stakes technology disputes.

James brings substantial technical depth to his practice. His work frequently involves complex technologies such as semiconductor fabrication processes, memory architecture, packaging technologies, video compression systems, wireless communication protocols, computer hardware design, and large-scale software systems. His technical training enables him to work closely with engineers and technical experts to translate complex engineering concepts into persuasive legal arguments.

James is also an experienced patent prosecutor, having prepared and prosecuted more than 70 patent applications. In addition, he advises clients on strategic patent portfolio development, portfolio management, and technology licensing, helping companies align their intellectual property strategy with broader business objectives.

James earned both his Juris Doctor and Master of Science in Computer Science from Washington University in St. Louis in an accelerated three-year program, reflecting his ability to bridge legal and technical disciplines. While in law school, he served as an Articles Editor of the Washington University Law Review.

James is registered to practice before the United States Patent and Trademark Office and is fluent in Mandarin Chinese. He has served as a guest lecturer at Soochow University School of Law and has been invited to speak at the Legal 500 GC Summit, where he presented on intellectual property litigation and cross-border technology disputes.
